Commercial Litigation

Commercial litigation is a daunting prospect for any business -- all the more so if it's your company that has been sued or if you have been wronged and need to fight for your rights. General Business Litigation. We offer cost-effective and knowledgeable representation in all manner of civil litigation, including contract disputes, professional liability, liquor liability, construction disputes, civil dishonesty claims, fraud, misrepresentation, as well as defense of personal injury and tort claims.

Creditors' Rights. Rich Carter has represented both creditors and debtors in bankruptcy proceedings, foreclosures, workouts, restructuring, and collections matters. We have the experience and expertise as advisors and advocates in order to resolve favorably debtor/creditor issues.

Employment and Human Rights Litigation. Our attorneys are especially well-versed in the administrative, state and federal court disputes arising from the employment relationship and from the general issues associated with denial of civil rights in public accommodations and services. Among the tribunals before which we practice are the local Virginia offices of Human Rights, D.C. Human Rights Commission, the EEOC, and, of course, state and federal courts. We have represented litigants in actions concerning Title VII, the D.C. Human Rights Act, Americans with Disabilities Act, Age Discrimination in Employment Act, Federal Fair Labor Standards Act, and a host of other federal, state and local anti-discrimination and fair employment practices claims. We also have represented a number of parties in 'whistle-blower', wrongful discharge, and wrongful hiring and training cases.

Administrative Claims. We also have experience before dozens of local, state, and federal regulatory agencies, representing clients in contested case proceedings before such diverse agencies as the Social Security Administration, Human Rights offices in Virginia and D.C., The DC Rental Accommodations and Conversion office and the Equal Employment Opportunity Office. We have a full command of rules for administrative procedure and hearings before administrative law judges and commissions.


Appellate Litigation. Sometimes trial decisions or preliminary rulings in a case turn out wrong, and an appeal is required. Our attorneys are experienced in identifying and documenting the complicated legal and factual issues which can be considered by a court of appeals, and in skillfully arguing those appeals before the state and federal courts. We also assist our clients in preparing and filing briefs amicus curiae in order to set before the court a position on issues which affect our client but in cases where the client is not already a party.

Mediation and Arbitration. Not every dispute ends up in court. Our attorneys have extensive experience in alternative dispute resolution, including mediation and both binding and non-binding arbitration. We know the special skills which can allow our clients= position to prevail in a less formal setting, and we know the importance of resolving such disputes in a timely and cost-effective manner. We have also served as court-appointed mediators and arbitrators in significant business disputes.
